OFFICIAL RULES
Eligibility and General Terms: The “I’m Glad I Bought a Toro Z!” video contest (the “Contest”) is open to owners of Toro residential zero-turn mowers who are residents of the U.S. and are 18 years of age or older. Contest is void where prohibited by law. Employees of The Toro Company (hereafter referred to as Toro), Toro distributors, Toro dealers, and their families are not eligible to participate in the video contest. All applicable federal, state, and local laws and regulations apply.
Contest Entry Period: The Contest begins Sept. 30, 2009 at 12:01 am CDT and ends at midnight CDT on Nov. 30, 2009, or when submissions reach a limit of 50 videos, whichever occurs first (the “Entry Deadline”). All entries must be submitted by the Entry Deadline.
How to Enter: To enter, upload your video entry to your yourtube.com account. Email us at torocontest@toro.com with the title of your video and your YouTube username. Make sure that you name your video starting with “toro_zcontest_(your title)". There is no limit on the number of video entries that can be submitted by an individual; however, only owners of Toro residential zero-turn mowers are eligible to win a prize. Toro will not be held responsible for incomplete, incorrect, or late entries. By participating, entrants agree to be bound by these official rules.
Create a video between 1 and 3 minutes in length showing or telling why “I’m Glad I Bought a Toro Z!”. All videos must be less than 2 gigabytes (GB) in size and be submitted in any of the acceptable file formats for YouTube. Videos will be available for viewing on YouTube.com/toro as soon as they are received and have been reviewed by Toro for compliance with contest rules and acceptability.
Your video must feature or include:
• a short testimonial about why you are glad you bought a Toro zero turn mower
• the phrase “I’m glad I bought a Toro Z”
• your Toro zero turn mower – in operation or at rest
The video may not:
• show any visible brands other than a Toro brand on clothing, equipment or elsewhere
• include any content that disparages any competitive mower or equipment
• contain any materials for which you do not have appropriate copyright or other necessary permission for use
You may want to tell about or show:
• a favorite feature of your mower
• how your zero turn mower saves you time
• how your zero turn mower has improved your life
• what you can do with your zero turn mower that you couldn’t do with your previous mower (mow into tight corners or around a tree?)
• how easy it is to use your zero turn mower
Video Safety Guidelines: Each entrant must adhere to the following safety guidelines for any Toro product(s) used in the video:
1) Read the owner’s manual and watch the safety DVD provided when the mower was purchased.
2) The individual recording the video cannot be operating the mower at the same time and must be a safe distance from the mower while it is in use.
3) Only the operator can be shown in the video when the mower is in use. Bystanders, children and animals must be a safe distance from the mower while in operation and must not be seen in the video.
4) The mower must not be used on a slope of greater than 15º or near drop offs, and must not be used in wet conditions.
5) Any entry showing any unsafe use of any Toro® product will be disqualified.
By submitting an entry, each entrant:
1) irrevocably grants Toro the royalty-free right throughout the world to use, re-use, copy, publish, republish in whole or in part, edit, add to, modify, and rearrange the contents of the entry in whatever media, including without limitation, to edit, rearrange, and/or copy the entry for use in the promotion of Toro’s products and services without further permission, consideration or payment to the entrant, except where prohibited;
2) warrants and represents that the entrant is the sole creator and copyright owner of the video submitted and that use by Toro of the entry as described herein will not violate any law or infringe upon the rights, title, claim or interest of any third party;
3) certifies that entrant has obtained from anyone identified or depicted in the video all permission necessary to submit the video and to grant Toro the right to use the video for the purposes described in these rules;
4) agrees to all the terms and conditions of these rules, to be bound by these rules and the decisions of Toro and the Contest judges, and consents to the use of his or her name and other information for purposes of direct mail or similar solicitations; and
5) releases Toro and its affiliates, subsidiaries, divisions, advertising and promotional agencies and their respective officers, directors and employees from any and all liability with respect to or arising out of participation in the Contest, or the acceptance, use, misuse or possession of any prize or the loss or misdirection of any prize.
All individuals appearing in the video must be at least 18 years of age. Only the person identified as the entrant will be eligible for any prize offered in this contest. Any other individual shown or identified in an entry will not be considered the entrant and will not be eligible to receive any prize offered in this Contest. No previously published video clips may be submitted nor will such a submission qualify as an entry.
Toro reserves the right to reject any or all entries that, in Toro’s sole discretion, depict use of a product in an unsafe manner or are otherwise inappropriate.
SELECTION OF WINNERS
On February 1, 2010, the Contest judges comprised of Toro marketing representatives will select the top five entries and post those videos on www.toro.com/zcontest. Entries will be judged on the following factors:
• How well they demonstrate the advantages of the Toro zero turn mower
• Creativity of the video
• Entertainment value
VOTING BY USERS
The top five finalists will be displayed at toro.com/zcontest starting February 1, 2010 where users can vote for their favorite video. Users may vote once per day during the Contest period, (February 1, 2010 until May 31, 2010 -- the “Voting Period”). The video receiving the highest overall rating combined with the most views will win the First Prize. The video receiving the second highest overall rating combined with second most views will win the Second Prize. In the event of a tie, the Contest judges will determine the winner based on the above criteria. The decisions of Toro and the Contest judges regarding entries and winners shall be final.
PRIZES
First Prize: $250 VISA debit card
Second Prize: $125 VISA debit card
Every entrant who submits a video that meets the criteria will receive an accessory for their mower such as a replacement blade kit, hitch kit, or engine guard, valued from approximately $40 to $70. All entrants posting videos will be contacted by Toro via their YouTube.com contact information to notify them of their contest eligibility; at that time, entrants of eligible videos will be asked to make their accessory choice. Only one accessory awarded per entrant, regardless of their number of eligible video entries.
Estimated total value of all prizes: $3875. Each winner accepts responsibility for compliance with any and all applicable federal, state and local laws pertaining to acceptance and use of each prize.
If an eligible winner does not claim a given prize, that prize will not be awarded.
CLAIMING PRIZES
Winners will be notified by phone or e-mail on or about June 15, 2010. To claim the prize, the winner must respond by e-mail or phone within 14 business days after prize notification at the phone number or e-mail address designated by Toro. Winners must promptly provide appropriate photo identification and must complete and sign an affidavit of eligibility and release. By accepting the first or second place prize, or submitting an eligible video, the entrant consents, where allowable, to promotional use of his or her name and likeness for advertising and promotional purposes without additional compensation, and releases Toro, its distributors and dealers from liability resulting from participation in the Contest or the acceptance or use of the prize. Failure to timely claim a prize and comply with the acceptance requirements will result in forfeiture of the prize. All federal, state and local taxes, if any, are the sole responsibility of the winner. Prizes may not be substituted and are not refundable, transferable or redeemable for cash, except at the sole discretion of Toro.
Odds of Winning: Dependent on the number of qualifying entries received.
Winner Information: The winner/winning entry will be announced on the toro.com/zcontest page and youtube.com/toro channel on or around June 30, 2010. The winning entry also can be obtained by sending an email to torocontest@toro.com, or by writing The Toro Company, RLC Marketing Department, Z Contest, 8111 Lyndale Ave. So., Bloomington, MN 55420. All requests must be received by July 15, 2010.
Miscellaneous: Toro reserves the right to revoke or cancel the Contest at any time if Contest materials contain errors or other mistakes. Toro is not liable for any technical or computer malfunctions related to the Contest or any Contest entries. Toro reserves the right to terminate the Contest for technical reasons such as a computer virus. Toro's decisions regarding all issues related to the Contest will be final.
